Sen. Chris Murphy Readies His Next ?Make It In America? Jobs Push

Now that he is a freshman senator, Connecticut Democrat Chris Murphy says he plans in the coming weeks to continue the push he started as a member of the House to advance a ?Make It in America? jobs agenda.

That agenda includes cracking down on China?s currency manipulation and violations of trade rules, tightening up ?Buy America? federal contracting provisions and encouraging federal investments that would boost the manufacturing sector.

Murphy spoke today on a call that included progressive writers and activists organized by the Campaign for America?s Future and the Alliance for American Manufacturing. (Listen to audio of the call.)

Murphy said that President Obama deserves credit for highlighting the need to create manufacturing jobs during his first term. Last year, the president promised to help create 1 million new manufacturing jobs by 2016 (a modest goal given the 5.5 million manufacturing jobs lost in the past decade). He said the president needs to underscore his commitment to that goal during his upcoming State of the Union speech.

?I?d like the president to make a pitch for investment in this country,? he said. That pitch includes the need for the federal government to invest in the infrastructure needed for economic growth, as well as the need to ensure American tax dollars are spent in ways that produce and sustain American jobs. ?American procurement can grow American industry,? Murphy said.

In his own state of Connecticut, Murphy said, there are shipping bottlenecks at the state?s ports because spending on maintenance and expansion has not kept up with the growth of commerce. That is just one example of nationwide under-investment in the transportation network that has to be addressed in order to sustain robust economic growth.

But to get the maximum impact of increased infrastructure investments, and federal spending generally, on American jobs, Murphy is calling for a tougher ?Buy America? statute than what is currently under the books.

That law generally requires that at least 50 percent of a product that is purchased with federal dollars be manufactured in America. That percentage is too low, Murphy said; it should be at least 75 percent and certainly no less than 60 percent. There are also copious exceptions and loopholes that need to be closed, he said, such as one that allows 100 percent foreign-made goods to be purchased by the federal government as long as they are used overseas. That exemption allowed the Defense Department to bypass Buy America rules for much of its procurement for the wars in Iraq and Afghanistan.

Murphy also said that he wants President Obama to continue his tough talk on China?s trade policies. The president has already been more aggressive in calling out China?s bad behavior than recent previous presidents, and ?the American public is begging for that trend to continue.?

We also have to bolster the federal role in supporting job training programs, including bolstering the employability of workers who do not have a collage education.

When Murphy was asked about the ability of getting elements of this agenda through the Republican-controlled House, Murphy responded, ?There is an examination happening within the Republican Party on why they lost votes and seats in 2012 ? and one of the reasons is they are on the wrong end of the outsourcing debate.?

Yet some of the campaign rhetoric of Republican lawmakers when they were candidates indicates that they understand the potency of the issue and that American public opinion is not with the organizations representing the interests of corporate outsourcers, such as the U.S. Chamber of Commerce and the Club for Growth. While those organizations have the campaign cash and lobbying muscle, the public has clear leverage as long as it continues to press its demands for a jobs-now, Make-It-In-America set of policies. ?Republicans can?t win if they continue to be the party of outsourcing.?

Robert Borosage, co-director of the Campaign for America?s Future, also on the call urged President Obama to make jobs, fair trade and reviving American manufacturing a key priority in his State of the Union speech.

?Today, the Campaign calls on the president to use his State of the Union address to lay out a elements of a new strategy for the United States to enable us to compete sensibly in the global marketplace.? Since a 2009 meeting of world leaders in Pittsburgh on trade, Borosage said, little has changed, with the U.S. running a trade deficit of about $1 billion a day.

?For all the talk about insourcing, companies have used the recession to continue to ship good jobs abroad. China and its Asian trading partners make up over 80 percent of the non-oil manufacturing trade deficit. Our trade relationship with China is the most unequal in the history of nations,? Borosage said.

?It is time for the U.S. to move to balancing its trade, as pledged in Pittsburgh. And to adopt a sensible national manufacturing strategy for the global economy. We believe this should be a centerpiece of the president?s State of the Union address, calling on the country to move from its increasingly self-destructive focus on austerity towards building a new foundation for growth,? he said.

Ex-adviser to Mass. gov is new US senator

BOSTON (AP) ? As Massachusetts' newest U.S. senator settles into his temporary job in the post previously held by Democrat John Kerry, attention is turning to a special election this summer when voters will pick Kerry's successor.

Democratic Gov. Deval Patrick appointed William "Mo" Cowan, his former chief of staff, on Wednesday to serve until June in the post left vacant by Kerry's confirmation as the nation's next secretary of state.

Given Congress' "fiscal cliff" agreement Jan. 1 and automatic spending cuts expected in March, Cowan said he backed a balanced approach to the nation's money problems that include some cuts and new revenues.

"I don't think anyone believes it's in the best interests to do straight across-the-board cuts," Cowan said, adding that such cuts would have "significant impact" on Massachusetts.

Some of the cuts could target grants to the state's highly regarded universities and research facilities.

Cowan will hold the office until voters decide June 25 on Kerry's successor. Already the race to fill Kerry's seat is shaping up.

Former U.S. Sen. Scott Brown, who lost his Republican re-election bid to Democratic Sen. Elizabeth Warren in November, is "leaning strongly" toward running in the special election, according to Republican officials. They spoke to The Associated Press on Tuesday on condition of anonymity because they were not authorized to share internal discussions.

Democratic Congressman Edward Markey of Malden has announced he's running for the seat, and U.S. Rep. Stephen Lynch of Boston, also a Democrat, is expected to announce his candidacy during a tour Thursday of the state. Kerry is among several leading Democrats who are backing Markey.

Cowan, 43, stepped down last month as chief of staff, a post he assumed in 2010 after previously serving as Patrick's chief legal counsel.

Patrick lauded Cowan for helping manage the state through the recession, and said Cowan had earned the respect of people throughout government.

"In every step, he has brought preparation, perspective, wisdom, sound judgment and clarity of purpose," Patrick said in announcing Cowan's appointment at a Statehouse news conference.

Patrick and Lt. Gov. Timothy Murray said the affable Cowan ? who eschewed his trademark bowtie for the announcement in favor of a traditional suit and necktie ? also brings a certain amount of "cool" to the job.

Cowan will be Massachusetts' second African-American senator. Edward Brooke, a Republican, served two terms from 1967 to 1979.

Cowan grew up in North Carolina and graduated from Duke University and from Northeastern University's law school. He was a partner in the prominent Boston law firm of Mintz Levin before going to work for Patrick, the state's first black governor.

Cowan noted Wednesday that his mother, who is recuperating in North Carolina after knee-replacement surgery, was a child of the segregated South who raised him and his sisters alone after his father died when Cowan was a teen.

White House spokesman Jay Carney said he believes President Barack Obama will be encouraged by Cowan's appointment, which coincides with a record number of female senators this year, "because he believes that diversity adds to the quality of debate."

In the days leading up to the selection, Patrick said he would consider diversity in his choice of interim senator. He also insisted the interim appointment be someone with no interest in holding the job permanently. And Cowan said Wednesday he had no intention of running for any elected office in the future.

"This is going to be a very short political career," he joked.

Former Democratic U.S. Rep. Barney Frank, who recently retired after more than three decades in the House, had been the only person to publicly express interest in the interim post and Patrick had acknowledged that Frank was among those he had considered.

Cowan's appointment marked the second time that Patrick has selected an interim U.S. senator. In 2009, following the death of Sen. Edward Kennedy, Patrick named Paul Kirk, a Democratic party operative and Kennedy family friend, to serve until a January 2010 special election, which Brown won.

Under Massachusetts law prior to 2004, governors appointed a senator to serve until the next regularly scheduled state election. The Democratic-controlled Legislature changed the law after Kerry became the 2004 Democratic presidential nominee to block then-Gov. Mitt Romney from appointing a Republican in case Kerry won the election.

Kerry's resignation from the Senate takes effect Friday, making Warren the state's senior senator despite having been in the Senate for only a few short weeks herself.

Japan to send investigators to US for 787 probe

TOKYO (AP) ? Japan's Civil Aviation Bureau is sending investigators looking into problems with Boeing 787 batteries to Seattle, where the aircraft are assembled.

The Transport Ministry said members of the team working on the investigation would leave Tokyo on Sunday for Seattle. It provided no further details.

The U.S. Federal Aviation Administration and Boeing earlier dispatched investigators to join the probe in Japan.

All 50 Boeing 787s in use were grounded after a lithium-ion battery in a 787 flight by All Nippon Airways on Jan. 16 overheated, forcing an emergency landing. Earlier in January, a 787 operated by ANA's rival Japan Airlines suffered a battery fire while parked at a Boston airport.

Investigators on both sides are trying to determine why the batteries have overheated and how to fix the problem.

Japan?s hawkish Prime Minister Shinzo Abe told parliament on Thursday that he intends to change the country?s post-second world war constitution, lowering the bar for further amendments.

?I will start with amending Article 96 of the constitution, a move that many factions [inside his Liberal Democratic Party] support ? Abe told upper house lawmakers, referring to the clause stipulating amendments require a two-thirds majority in parliament.

In the run-up to his landslide election victory in December, Abe said he wanted to study the possibility of altering the definition of Japan?s armed forces contained in the document.

The country?s well-funded and well-equipped military is referred to as the Self-Defence Forces, and barred from taking aggressive action. Its role is limited to defence of the nation.

Abe has said he would like to look into making the SDF into a full-fledged military, a plan that sets alarm bells ringing in Asian countries subject to Japan?s sometimes-brutal occupation in the first half of the 20th century.

US occupying forces imposed the constitution in the aftermath of the second world war, but its war-renouncing Article Nine is held dear by many Japanese.

Boston Scientific reports weaker results, sets job cuts

(Reuters) - Boston Scientific Corp reported weaker quarterly earnings on Tuesday as sales slipped and expenses rose, and the medical device maker announced more job cuts.

The company said it expected to eliminate 900 to 1,000 jobs worldwide through 2013, bringing the total headcount reduction to 2,100 to 2,400 positions from 2011 to 2013.

Boston Scientific employs 24,000 workers worldwide, according to its website.

Fourth-quarter net earnings fell to $60 million, or 4 cents per share, from $107 million, or 7 cents per share, a year earlier, the company said.

Excluding special items, earnings were 11 cents per share, matching the average estimate on Wall Street, according to Thomson Reuters I/B/E/S.

Revenue dipped to $1.82 billion from $1.85 billion as sales slipped in the interventional cardiology business, which sells heart stents, and in the cardiac rhythm management business, which sells pacemakers and implantable heart defibrillators. Those two businesses make up more than half of Boston Scientific's total revenue.

Sales rose in the company's other smaller businesses, including urology and women's heath, endoscopy and neuromodulation.

The company forecast first-quarter earnings of 4 cents to 7 per share. It expects adjusted earnings, excluding charges for restructuring, acquisitions and amortization, to be 14 cents to 17 cents per share, with sales of $1.74 billion to $1.82 billion.

For the full year, Boston Scientific estimated earnings at 29 cents to 37 cents per share. It said it expected adjusted earnings of between 64 cents and 70 cents per share on sales of $7.05 billion to $7.35 billion.

'Higher cost' of forensic closure

The cost of closing down the Forensic Science Service (FSS) could be more than three times the UK government's estimate, says a leading researcher.

The Home Office quotes a figure of ?95m for shutting the service, which once employed 1,600 people.

But Dr Chris Maguire said it would be between ?300m and ?350m when other expenditure, such as taking forensics work inside police forces, is included.

The FSS had been losing ?2m per month when its closure was announced in 2010.

The government said allowing it to go into administration would have endangered criminal justice.

Its plan was for private enterprise to expand into the gap left behind by the FSS.

The work by Dr Maguire, from Northumbria University Centre for Forensic Science, is one of the first independent estimates of the cost to the British taxpayer of shutting the service.

He spent 30 years as a scientist with the FSS, before taking up his academic position in 2010.

Compiled using publicly available data as well as details gathered through Freedom of Information (FOI) requests, the results are outlined in the scientist's written evidence to a select committee follow-up inquiry into the closure.

Dr Maguire is preparing a full paper on the matter for submission to an academic journal.

"The actual costs of FSS closure must lie somewhere between ?300m and ?350m, if all of the costs of the police in-sourcing of forensic science activities formerly delivered by [forensic science providers] are taken into account," Dr Maguire explains in his written evidence.

In-house work

"In-sourcing" describes the practice by which police forces bring forensic work in-house in order to make cost savings.

The calculation includes the ?60m cost of running a Metropolitan Police lab in Lambeth - where 120 FSS staff were transferred after the closure - over 10 years - a cost, says Dr Maguire, "that is being borne by the Met Police as opposed to anyone else".

It also factors in the cost of operating the national forensic archive for 10 years (?20m), the ?21m spent on the construction of a new laboratory in Wakefield, West Yorkshire, and an ?18m loan that was written off.

"What has actually been the cost? It's not simply the cost of paying off the staff, paying off contracts to run buildings, or getting out of leases," Dr Maguire told BBC News.

He said the level of expenditure needed to shut down the service could have maintained the FSS in perpetuity even if the government had pumped in ?1m per month.

In December 2011, Foreign Secretary William Hague wrote to the European Commission stating that the closure of the FSS required support of about ?100m.

In its submission to the follow-up inquiry, the Home Office estimated the final cost of closure would be around ?95m.

It explained that it had excluded a ?20m provision to cover a deficit in the accrued pension benefits for FSS staff, which the government is protecting. But the Home Office argued this liability was not a cost of closure as it reflected an existing deficit in the pension scheme.

Private providers complain that the practice of in-sourcing acts as an impediment to the expansion of the forensic market.

Private forensics firm LGC estimates that the size of this forensics market, outside the work police do themselves, fell from roughly ?155m in 2010 to ?70-80m in 2012.

In 2011, crime and security minister James Brokenshire said the external market was likely to contract to 110m, but only by 2015.

A Home Office spokesperson told BBC News: "The Forensic Science Service was losing ?2m a month and had to be wound down in order to protect taxpayers from further costs. The total direct cost of closure is around ?95m and the figure provided by Dr Maguire is not accurate."

Erectile Dysfunction Raises Risk of Hospitalization for Heart Woes

The more severe a man's erectile dysfunction is, the greater his risk of being hospitalized for heart problems, a new Australian study finds.

Among men in the study who had no history of heart disease, those with moderate erectile dysfunction (ED) were 23 percent more likely to be hospitalized for a cardiovascular problem, such as a heart attack, during a two-year period compared to men who did not have ED. And those with severe ED were 35 percent more likely to be hospitalized for cardiovascular problems than those without ED.

Men who already had heart problems and severe erectile dysfunction at the study's start were 64 percent more likely to be hospitalized for another heart problem during the study period compared to men without ED.

The results held even after the researchers accounted for factors that might increase the risk of heart problems, such as age, smoking, alcohol consumption and obesity.

The findings agree with previous studies that have linked erectile dysfunction to an increased risk of cardiovascular disease. [See For Men, Sex Life Gets Better with Improved Heart Health.] But the new study is one of the first to investigate whether or not the risk of heart problems increases with the severity of ED.

The findings suggest erectile dysfunction may be a marker that signals underlying heart disease, the researchers, from Australian National University, said. It has been hypothesized that atherosclerosis (plaque in the arteries that limits blood flow) might first manifest itself in smaller blood vessels, such as those in the penis, the researchers said.

When a man sees the doctor for erectile dysfunction, the visit might be an opportunity to evaluate him for other problems, said Dr. Andrew Kramer, a urologist at the University of Maryland Medical Center, who was not involved in the study.

"You can use ED to get men in the door. It might be the only thing that brings them in," Kramer said. Urologists should encourage men with moderate or severe ED to visit a primary care doctor or cardiologist for heart disease screening, he said.

The researchers examined information from more than 95,000 Australian men ages 45 and over who filled out a health questionnaire between 2006 and 2009, and linked this information to records of hospital admissions and deaths in 2010.

During the study period, there were 7,855 hospital admissions related to cardiovascular disease and 2,304 deaths, the researchers said.

Men with erectile dysfunction of any severity (mild, moderate or severe) were at increased risk for hospitalization for heart failure compared to men who did not have ED.

Those with severe ED were about twice as likely to die during the study period than men without ED, the researchers said.

The study only found an association, not a cause-effect link. The researchers also did not have information about any medications participants were taking (some medications have ED as a side effect.)

The study was published today (Jan. 29) in the journal PLOS Medicine.

Of course you didn't, nobody wonders that. But according to a new study led by Kyushu University's Hirofumi Tachibana, it could be true! He gave mice suffering from cancer a cocktail of green tea and PDE5 inhibitors (the kind of drug in Viagra, Cialis, Levitra, and other brands of erectile dysfunction medication), finding that malignant cells stopped growing when subjects took the healthy/arousing mixture. The EGCG catechin found in green tea has long been thought to have cancer fighting properties, but Tachibana's work shows that the PDE5 enzyme could be stifling it. Luckily, we already have a drug that suppresses PDE5, and it just happens to be used for erectile dysfunction. Tachibana warns the public from trying this remedy at home right now, and in the meantime researchers in the U.S. plan to set up human trials this year.?[The Japan Times]

Cell phone towers are killing many birds. The verdict's out on cell phones' link with brain cancer, but it's very clear cell phones are having a negative effect on bird populations. And many of them are rare species, such as the yellow rail (2,000 die from cell phone tower collisions each year, and there are only about 20,000 total). Enormous wave dwarfs surfer Garrett McNamara along coast of Portugal

Surfer Garrett McNamara catches what could be the largest wave ever surfed, off the coast of Nazare, Portugal, on Jan. 29. The estimated 100-foot wave, if confirmed, would beat the current world record of 78 feet, which McNamara has held since 2011. According to SurferToday.com:

Garrett McNamara traveled from Hawaii and hit the water with Kealii Mamala - with whom he surfed waves generated by glacier blocks in Alaska - Kamaki Worthington and Hugo Vau, as their support team on the jet ski. The conditions in Nazar? were heavenly perfect. Light southern winds and strong swell coming from northwest and hitting the local canyon as it should.

Judges with Billabong XXL Global Big Wave Awards will work to determine the actual size of the wave.

McNamara's surfing skills developed when his family moved to Hawaii from Pittsfield, Massachusetts, when he was 11 years old. As a professional big wave surfer, he regularly seeks out the largest waves in the world.

"It's like riding a moving mountain," said McNamara to TODAY after he broke the last world record in 2011. Watch the video.

Gay Scouts, leaders not ready to forgive just yet

One decade ago, the US Supreme Court ruled the Scouts had the legal right to exclude gays, but the organization's new policy would allow local troops would be able to decide the issue for themselves. NBC's Pete Williams reports.

Jennifer Tyrrell cried when she got the news Monday that the Boy Scouts of America may be changing its policy to admit gays and lesbians as Scouts and leaders.

The mother of four children was kicked out of the organization last year, as den leader of her son?s Tiger Cub pack in Ohio, because she is a lesbian. The longstanding policy has sometimes seen the quiet, or in Tyrrell?s case, public, exit of gays ? an exodus that has rocked the Boy Scouts and led to growing calls for the group to open its doors to all who want to join.

?I?m looking forward to the day when we can once again take part,? Tyrrell told NBC News by phone, reminiscing about all of the fun activities she so enjoyed with her son Cruz and the youth in her pack, such as the Pinewood Derby and campfires. ?This is a gigantic leap, especially on this ? decades-old policy that they have gone to the Supreme Court to defend. ? Of course it?s not the ultimate, but it?s definitely a great hurdle.?

It?s not the ultimate, according to Tyrrell and others, because the proposal would eliminate the ban at the national level, but would allow local sponsoring organizations to decide whether or not they would accept gays, NBC News? Pete Williams reported.

?So essentially, instead of forcing people to discriminate they?re going to allow people to discriminate,? said Zach Wahls, who is the son of a lesbian couple and who has been leading a campaign fighting to include lesbians and gays in the Scouts. ?Even though one is less bad than the other, we still need to make sure that local units are understanding how a ban on gay members negatively affects their unit.?

Still, Wahls said, it was a step in the right direction though the Boy Scouts do have a ways to go.

?Compared to where we were seven months ago, with the BSA, you know, calling this the best policy for the organization right now and then seven months later understanding well actually ? that?s not quite true, it?s a big development,? he added.

Wahls was referring to the Boy Scouts announcement last July that it was sticking with the policy after revealing it had undertaken a confidential two-year review of the disputed membership guidelines. It also came a few months after Tyrrell was forced out and a day before she handed in a petition to national leaders with hundreds of thousands of signatures calling for her reinstatement.

That prompted a number of Eagle Scouts to turn in their hard-earned regalia, with more than 200 posting their letters and photos of their medals, pins or certificates to a tumblr page?started by Burke Stansbury, a 36-year-old communications specialist in Seattle, Wash., who decided to leave the Scouts for good over the issue.

Stansbury welcomed the news of the proposed change but said he wasn?t sure if he would ever go back.

?I sort of said all along that I was really making a decision to do this, that they?ve held on too long and that, you know, I?ve lost faith in the organization regardless of what changes they might make in the future,? he said.

Stansbury said he would wait and see if the Boy Scouts ended up reversing the policy and if they ?actively worked to be an open and inclusive organization.?

The discussion of the potential change in policy is nearing its final stages, according to outside scouting supporters. If approved, the change could be announced as early as next week, after the BSA's national board holds a regularly scheduled meeting.

?Before I made any decision about rejoining or asking for my medal back, I?d really want to see that it was being implemented but yeah ? I am certainly open to seeing what happens and I mean, there is you know, much to love about the Boy Scouts as an organization,? he said. ?So if they were to change, it would take some time, I think, to rebuild the trust of people like me who lost faith. But I think it?s still possible.?

One of those most impacted recently by the Boy Scouts? policy was Ryan Andresen, 18, and his family. Andresen said he was denied submitting his application for the Eagle rank to the national organization by his Scoutmaster after finishing his final service project last fall because he is gay, and after coming out as gay to his troop last summer.

After much back and forth with the local council in Moraga, Calif., and hard feelings on both sides in a story that made national headlines for weeks, his application for the pinnacle Boy Scouts? achievement was forwarded to the national headquarters for approval, said his father Eric Andresen, 52.

Ryan, a high school senior, was still hoping for the award, even though he already knows he has earned it, Eric Andresen said.

?Four months ago, if the ban hadn?t been in place, we wouldn?t even been going down this road. ? He?s been hurt a lot. There?s been a lot of damage done to Ryan emotionally,? he said Monday. ?If the board does elect to get rid of the policy, I don?t know why they wouldn?t then retroactively award Ryan his Eagle. They certainly should.?

Eric Andresen, who resigned as the committee chair of his son?s troop after the problems began, said he was done with the organization after 10 years as an adult leader, but he hadn?t yet broached the possibility with his son of being able to participate as a volunteer or leader one day if the policy is changed.

?I don?t think that?s a conversation that ? I?d even want to start it with him right now,? he said, noting that after Ryan spent a dozen years with the Boy Scouts, the group ?turned its back on him? and was ?responsible for all of the grief he?s gone through the last four months.?

One of the Andresen?s main objectives was to help others, such as boys who may still be hiding in the closet.

?If BSA does do the right thing ? we?re looking at, you know, what this is going to do for thousands of other Scouts so that nobody else has to go through what Ryan went through,? he said. ?It?s time to end this stuff. Gay kids have a right to be Scouts, too.?

Chris Brown reportedly in fight over parking

Grammy-winning singer Chris Brown is being investigated following an alleged fight over a parking space in West Hollywood, police said early Monday.

Authorities responded to a call of a fight involving six males in Santa Monica Boulevard, the LA County Sheriff's Department said in a statement.

"Deputies talked to witnesses who stated that Chris Brown and the victim were involved in an altercation over a parking space," the statement added. "The altercation allegedly led to Chris Brown punching the victim."

Brown had already left when officers arrived, police said.

Police said they had not yet been in contact with Brown. No arrests have been made.

Library solves animal control's puppy poop problem

SAN FRANCISCO (AP) ? San Francisco's animal control agency is proving that the print editions of newspapers remain just as vital in the digital age.

The agency relies on the papers to line cages and catch its puppy's poop. It is now turning to the city's public library to ensure a consistent newspaper supply.

The San Francisco Chronicle reports that the agency will pick up newspapers from the library about twice a month.

Agency supervisor Eric Zuercher says the arrangement has solved a big problem, noting puppies are poop machines.

The agency had previously relied on public contributions and donations from the Chronicle.

Barge with 80,000 gallons oil hits bridge, leaks

A barge carrying 80,000 gallons of oil hit a railroad bridge in Vicksburg, Miss., on Sunday, spilling light crude into the Mississippi River and closing the waterway for eight miles in each direction, the Coast Guard said. A second barge was damaged.

Investigators did not know how much had spilled, but an oily sheen was reported as far as three miles downriver of Vicksburg after the 1:12 a.m. incident, said Lt. Ryan Gomez of the Coast Guard's office in Memphis, Tenn.

Authorities were still trying to determine the source of the leak, but it appeared to be coming from one or two tanks located at the stern of the first barge, Gomez said. He said there was no indication that any oil was leaking from the second vessel, and said it was still unclear whether the second barge also hit the bridge or was damaged through a collision with the first.

"Investigators are still trying to figure out what happened," he said.

The privately owned response-and-remediation company United States Environmental Services was working to contain the oil with booms before collecting it and transferring it to one of the barge's undamaged tanks, then ultimately to a separate barge, Gomez said. He could not say how long the river would remain closed in the area. Five northbound and two southbound vessels were waiting to pass, he said.

"It's still considered an active leak," Gomez said. "We don't have an estimate or accurate amount of what was released."

Railroad traffic was allowed to continue after the bridge was found safe for trains, Petty Officer Carlos Vega said.

The barges are owned by Third Coast Towing LLC, Gomez said. According to a website listed under that name, the company is located in Corpus Christi, Texas. No one answered the telephone at the company Sunday night.

Both vessels were being pushed by the tugboat Nature's Way Endeavor. The website for Nature's Way Marine LLC of Theodore, Ala., identifies the vessel as a 3,000-horsepower, 90-foot-long boat, making it the largest and highest-powered of the company's five tugs. It was built in 1974 and underwent a complete rebuild in 2011, according to the company.

A company manager referred calls to the Coast Guard command center at Vicksburg.

The last time an oil spill closed a portion of the lower Mississippi River, it was for less than a day last February after an oil barge and a construction barge collided, spilling less than 10,000 gallons of oil. In 2008, a fuel barge collided with a tanker and broke in half, dumping 283,000 gallons of heavy crude into the waterway, and closing the river for six days.

The oil sheen from Sunday's incident was unlikely to pose a threat to the Gulf of Mexico, located 344 river miles south of Vicksburg.

Residents and businesses in Gulf Coast states are still recovering from the April 2010 explosion of the Deepwater Horizon drilling rig, which killed 11 workers and spewed more than 200 million gallons of oil into the Gulf.

SAN FRANCISCO (AP) ? Yahoo got a little healthier during the last three months of 2012 as the long-suffering Internet company took advantage of higher ad prices and more money coming in from overseas investments to deliver numbers that exceeded analyst forecasts.

The results announced Monday covered Yahoo's first full quarter under CEO Marissa Mayer. Yahoo Inc. lured Mayer away from Google Inc. in mid-July in its latest attempt to snap out of a funk that had depressed its revenue and stock price.

Although Yahoo still isn't keeping pace with the overall growth of the Internet ad market, the company fared well enough during the fourth quarter to produce its first full-year gain in revenue since 2008. It was a scant increase: just $2.4 million higher than 2011's total of nearly $5 billion.

Yahoo is now being run by its fifth permanent or interim CEO since 2008.

Mayer, 37, has raised hopes among investors and employees with her Google pedigree and her pledge to transform Yahoo's website into a mesmerizing destination that attracts Web surfers and advertisers. During her first six months on the job, she has primarily focused on boosting employee morale and building better mobile and social-networking services so Yahoo can make more money from two of technology's hottest trends.

"The future of Yahoo will be about innovation, execution and continued progress on a multi-year march toward growth, delighting users and driving shareholder value," Mayer assured analysts in a Monday conference call.

Investors seem convinced Mayer is headed in the right direction. Yahoo's stock added 50 cents, or nearly 2.5 percent, to $20.81 in extended trading. The shares are up by more than 30 percent since Mayer joined the Sunnyvale, Calif., company.

Yahoo has been feeding the rally by using part of a $7.6 billion windfall that it received from selling half its stake in Chinese Internet company Alibaba Group. The company spent $1.5 billion buying back nearly 80 million of its shares at an average price of $18.24 in the fourth quarter. Buybacks help boost the stock price for remaining shareholders.

Mayer highlighted some of the company's recent strides during the conference call. She said internal surveys show 95 percent of Yahoo's 11,500 employees are optimistic about the company's future. Mayer also touted the potential of a recent redesign of Yahoo's email, saying the number of daily users has increased by 10 percent since the changes were unveiled last month.

Yet Mayer's efforts haven't made a huge difference in Yahoo's ad sales ? the company's main way of making money.

For instance, during the final three months of last year, Yahoo's ad revenue was $1.07 billion, roughly the same as a year earlier. By contrast, fourth-quarter ad revenue at Google surged by 19 percent from the previous year. Another rival, Facebook Inc., is expected to post much stronger ad growth Wednesday when the Internet social-networking leader is scheduled to release its fourth-quarter report.

Overall, Yahoo's fourth-quarter earnings dipped 8 percent to $272 million, or 23 cents per share, down from $296 million, or 24 cents per share. The earnings would have been higher than the previous year, if not for a charge to close its South Korea operations and other one-time accounting items.

If not for those charges, Yahoo said it would have earned 32 cents per share. On that basis, Yahoo topped the average estimate of 27 cents per share among analysts surveyed by FactSet.

Yahoo's fourth-quarter revenue increased 2 percent from the previous year to $1.35 billion.

After subtracting advertising commissions, Yahoo's fourth-quarter revenue stood at $1.22 billion ? about $10 million above analyst forecasts.

Yahoo apparently isn't expecting a big upturn this year. The company predicted its revenue, minus commissions, will range from $1.07 billion to $1.1 billion in the current quarter. That's slightly below analysts' average estimate of $1.12 billion.

In an encouraging sign, Yahoo's average price for display advertising on its website during the fourth quarter rose 7 percent from the previous year. Meanwhile, the average price for Yahoo's search ads increased by 1 percent from the previous year. This marked the first time that Yahoo has detailed the changes in its ad rates from the previous year. The fourth-quarter improvement could be an indication that advertisers believe Mayer's changes are starting to pay off.

Yahoo still needs to work on increasing the volume of display advertising, which declined by 10 percent from the previous year. The number of revenue-generating search ads, though, increased 11 percent from the previous year. That improvement provided proof that Yahoo is harvesting better returns from its Internet-search partnership with Microsoft Corp. The alliance has allowed Yahoo to lower its expenses by relying on Microsoft's technology for most of its search results, but the arrangement had been producing disappointing returns on the advertising front until recently.

Yahoo is still benefiting from its remaining holdings in Alibaba, as well as a roughly 35 percent in Yahoo Japan. Yahoo's fourth-quarter income from its investments increased 17 percent from the previous year to nearly $149 million. Because of a lag in how Yahoo books income from international revenue, the company's results still don't fully reflect the reduced stake in Alibaba. That will occur this year, reducing Yahoo's overseas earnings.

    Senate immigration reform backers seek quick action

    WASHINGTON (Reuters) - A bipartisan group of senators who have agreed on an immigration reform plan said on Monday they hope to move quickly with legislation giving 11 million illegal immigrants a chance to eventually become American citizens.

    The four Democrats and four Republicans released the outline of a comprehensive immigration reform effort - one with plenty of details missing - that still must be turned into legislation.

    At a news conference on the proposal, Democratic Senator Charles Schumer of New York, one of the eight working on the initiative, said he hoped it could be passed by the Senate in late spring or early summer.

    In an attempt to build support among lawmakers, the Senate proposal would couple immigration reform with enhanced security efforts aimed at preventing illegal immigration and ensuring that those foreigners here temporarily return home when their visas expire.

    A Republican member of the group, Senator Lindsey Graham of South Carolina, said he hoped for an overwhelming vote of support in the Senate, which could enhance chances of a bill passing the Republican-controlled House of Representatives.

    But Graham also warned, "If for some reason we fail in our efforts to pass comprehensive immigration reform, I do believe it will be many years before anyone is willing to try and solve this problem."

    The plan, which faces an uncertain future in Congress, was unveiled a day before President Barack Obama was to give a policy speech on immigration in Nevada.

    With Republicans regrouping after November elections in which they failed to garner significant support from Hispanic voters, there are other indications immigration reform could be on a fast track in the newly convened 113th Congress.

    A bipartisan group in the House also is close to unveiling its own immigration proposals, according to the congressional source with knowledge of the reform efforts.

    The source said the House group could detail its outline either later this week or next week.

    No one expects an easy path for any of the proposals, which are still being developed and lack detail.

    The last comprehensive revision of the nation's immigration law was in 1986. Numerous efforts since then have encountered stiff resistance, especially from the conservative wing of the Republican Party, which as recently as the Republican presidential primary races in 2012 opposed anything resembling an "amnesty" for undocumented immigrants.

    "When you legalize those who are in the country illegally, it costs taxpayers millions of dollars, costs American workers thousands of jobs and encourages more illegal immigration," warned Republican Representative Lamar Smith, who is the former chairman of the House Judiciary Committee.

    With the electoral power of Hispanic voters growing rapidly, however, leading Republicans have been urging conservatives to rethink both their positions and their rhetoric.

    The Senate group included Republican Senator Marco Rubio of Florida. Democratic Senate Majority Leader Harry Reid expressed his support for the effort.

    Under its proposal, undocumented immigrants would be allowed to register with the government, pay a fine, and then be given probationary legal status allowing them to work.

    Ultimately, they would have to "go to the end of the line" and apply for permanent status.

    The White House praised the group's efforts but warned that Obama would not be satisfied until there was meaningful reform. The president "will continue to urge Congress to act until that is achieved," a White House spokesman said.
